MPELRA Manual Access Policy Statement

The Michigan Public Employer Labor Relations Association (MPELRA) is the exclusive owner of all copyrights in the Manual and any articles, chapters or other materials (‘Manual”) published by MPELRA on the Manual pages or other pages on MPELRA’s website to which you have been granted access by assignment of a password. Membership access to the Manual is limited to MPELRA Members and no others, and only while their membership is current and fully paid for in accordance with MPELRA Membership Policies. Any access to the Manual by Members whose membership is not current or fully paid for is strictly prohibited. Granting of access to the Manual and the assignment of a password for such access terminates immediately upon termination of Membership regardless of the circumstances of the termination.

Access to the Manual may also be provided by MPELRA to non-members (“Assignees”) under other limited circumstances by assignment of a password to the Manual under Non-Membership Policies. Assignment of password access to the Manual under such policies entitles only the Assignee and no others to access the Manual and only for the period of time or the existence of circumstances under which the password access is granted and valid under Non-Membership Policies. Any access to the Manual by Assignees whose assignment is not current or fully paid for is strictly prohibited. Granting of access to the Manual and the assignment of a password for such access terminates immediately upon termination of assignment regardless of the circumstances of the termination.

Regardless of whether password access to the Manual is granted to you under Membership or Non-Membership Policies, any unauthorized copying or distribution (downloading, uploading, file serving, file sharing, sharing of downloaded copies, or other similar activities) of MPELRA Manual materials is strictly prohibited and will be deemed an infringement on MPELRA’s copyrights in violation of the U.S. Copyright Act.

Similarly, sharing or other distribution of passwords to others who have not been granted password access under MPELRA Policies is strictly prohibited and will be deemed an infringement of MPERLA’s copyrights as well as theft of MPELRA property.

MPELRA will pursue every available remedy including injunctions and recovery of attorney’s fees, costs and damages incurred by MPELRA as well as any available criminal penalties as a result of the actions and violations of MPELRA Rights or Policies listed above. Nothing contained or omitted from this Manual Access Policy Statement is, or shall be deemed to be either a full statement of the facts or applicable law, an admission of any fact, or a waiver or limitation of any of MPELRA’s rights or remedies, all of which are specifically retained and reserved…
